Terms of Use

Welcome to AscendFive! These Terms govern access to and use of the AscendFive platform ("Platform"). By creating an account or using the Platform, you represent that you have read, understood, and fully accepted these Terms. If you do not agree, please do not use AscendFive.

1. Account Deletion

  • You may delete your account under Edit Profile > Verify Account. This action is irreversible, except for data we must retain due to legal obligations.

2. User Conduct and Zero-Tolerance Policy

  • It is prohibited to post illegal, abusive, discriminatory, or threatening content, or content that harasses other users.
  • It is prohibited to impersonate another person, use the Platform for fraudulent purposes, or artificially manipulate the rating system (fake accounts, user coordination, bots).
  • Zero tolerance: AscendFive may remove content or suspend/delete accounts, with or without prior notice, whenever it identifies a violation of these Terms.

3. Moderation, Filtering, and Reports

  • We use automated filters combined with human review to identify content that violates these Terms.
  • Reports are reviewed within 24 hours of receipt, and this period may be extended in more complex cases.
  • Any user may block another user directly on the Platform.

4. Suspension and Termination by the Platform

  • We may suspend or terminate your account, temporarily or permanently, in cases of violation of these Terms, suspected fraud, or manipulation of the rating system.

5. Services Provided

  • AscendFive is a digital platform for profiles, interaction, and community.
  • We may modify, suspend, or discontinue any feature at our discretion, at any time.
  • We do not guarantee uninterrupted, timely, or error-free availability.

6. Eligibility and Registration

  • Minimum age: 16 years old. Users between 16 and 18 may only use the Platform with consent from a parent or legal guardian, given both when accepting these Terms and during the identity verification process, which requires an identification document from the minor and from the legal guardian.
  • Identity verification: carried out through submission of an official document and a short video, reviewed by a human verifier for manual account approval. We also use phone numbers for SMS verification.
  • You are responsible for the security of your account and the accuracy of the information you provide.
  • Creating more than one account to circumvent restrictions or the reputation system is prohibited.
  • Paid service: certain features, including rating other users, require a paid subscription (processed via Stripe), which may be canceled at any time. Upon cancellation, the user loses the ability to rate others and their reputation is no longer displayed publicly, though the score itself is not lost — it reappears if the subscription is reactivated.

7. Ratings and Responsibility

Users are solely responsible for the ratings they submit. AscendFive does not endorse, verify, or take responsibility for the opinions expressed.

Rating System

  • Each user's reputation is calculated based on criteria defined internally by the Platform, considering, among other factors, the rating given (1 to 5 stars) and the rater's own reputation.
  • Real-life interactions: ratings resulting from a real-life interaction between users (for example, after a conversation) may carry greater weight, up to 25% more, than ratings without this kind of prior interaction — this applies to both positive and negative ratings.
  • AscendFive does not publicly disclose the exact calculation formula, in order to preserve the integrity of the system.
  • Reputation is displayed on a scale from 1.000 to 5.000, with three decimal places.
  • Usage rules: rating your own account is not allowed; posts may be rated only once per user; there is a minimum interval between ratings of the same person; and repetitive patterns of identical ratings may be blocked.
  • Any attempt to artificially manipulate this system is prohibited and may result in account suspension or deletion.

8. Privacy and Data Protection (LGPD)

The processing of personal data is governed by our Privacy Policy, prepared in accordance with Brazil's General Data Protection Law (Law No. 13,709/2018). Documents and video submitted during the identity verification process, including documents from legal guardians in the case of users under 18, are used exclusively for verification purposes and are deleted within 60 days after the process is completed. You may exercise your rights as a data subject (access, correction, deletion, portability) through the contact channels listed in the footer.

9. User-Generated Content

AscendFive acts as a technology intermediary and does not produce, edit, or endorse content posted by users. Each user is solely responsible for the content they post.

10. Intellectual Property

You retain the rights to your content, but you grant us a license to host, display, and distribute it within the Platform. Our brand, logo, and software are protected by law, and their reproduction or reverse engineering is prohibited.

11. Limitation of Liability

AscendFive is provided 'as is' and 'as available,' without warranties of any kind. We are not liable for user-generated content, ratings, interactions between users, or indirect damages arising from use of the Platform, except where liability cannot be limited under the Consumer Protection Code and the LGPD.

12. Indemnification

You agree to indemnify AscendFive for claims or damages arising from your violation of these Terms or misuse of the Platform.

13. Changes to These Terms

We may change these Terms at any time. Continued use of the Platform after changes are published constitutes acceptance of the new version.

14. General Provisions

Governed by the laws of the Federative Republic of Brazil. Use of the Platform constitutes full acceptance of these Terms.
